The Sierra Club filed suit in state district court this week to try to force the Texas Commission on Environmental Quality to grant a contested case hearing to the Sierra Club and about a dozen residents of Eunice, New Mexico. The environmental activist group objected to TCEQ's awarding of a license to Waste Control Specialists LLC (WCS), allowing them to build a waste dump in Andrews County right on the Texas-NM border.
The Sierra Club has argued that problems exist with WCS's application for the license including a failure to adequately characterize underground geology. The Sierra Club and Eunice residents say that there is water under the prospective disposal site -- which residents of Eunice drink.
