The Austin political newsletter Lone Star Report recently filed an open records request with the Texas Higher Education Coordinating Board for the number of illegal immigrants that received in-state tuition. In fiscal year 2005, 3150 illegal immigrants received in-state tuition at Texas four-year universities, while 8300 illegal immigrants received in-state tuition at Texas two-year community colleges. The college with the most illegal immigrants receiving in-state tuition is the University of Texas at Dallas with 715, while the community college with the most illegal immigrants receiving in-state tuition is Houston Community College at 1460.
In 2001, the legislature passed HB 1403, which allows illegal immigrants who graduated from Texas high schools to receive in-state tuition. To get the benefit, they must sign an affidavit promising to apply for legal status as soon as they have the opportunity to do so. Comptroller Carole Keeton Strayhorn has criticized Gov. Rick Perry for signing HB 1403 and has called for its repeal.
